The Website is owned and operated by The Mindandko Private Limited, a private mental health service company incorporated under the Companies Act, 2013, with its registered office at 466, Pantheon Road, Egmore, Chennai – 600008.

By accessing or using our services, you agree to these Terms. Please read them carefully.

The Mind & Company is a psychological wellness platform that delivers emotional wellness products and services to individuals and organisations. These include, but are not restricted to:

• Face-to-face consultations with qualified mental health professionals (authorised by The Mind & Company), offered in one-to-one or group formats, within India.
• Online consultations with users based in India or outside India, conducted through secure video, audio, or chat-based sessions.
• Periodic self-assessments and psychological tests to support progress tracking, early identification of concerns, and reflective practice.
• Workshops and webinars facilitated by trained mental health professionals, covering stress management, resilience building, and workplace well-being.
• Self-help tools, content, and structured programmes offered across channels including websites, mobile applications, and emails.
• Confidential communication tools that allow clients to exchange private, encrypted messages with their professionals.
• Corporate wellness programmes — employee assistance services, workplace mental health initiatives, and stress management programmes.
• Community support initiatives — user forums, group discussions, peer networks, and awareness programmes that encourage shared learning and reduce stigma.

Our services comply with our client anonymity and confidentiality policies applicable in India (refer to our Privacy Policy). The Mind & Company reserves the right to add, modify, or remove products and services without prior notification.

Use of the Website is available to:

• Adults: Persons over 18 years who are competent to contract under Indian law.
• Minors: Persons under 18 years with proper parental/guardian consent through our Consent Form.
• Corporate Users: Authorized representatives of organizations with proper corporate agreements.

Our services may only be available in certain jurisdictions where our experts are licensed to practice. Users accessing Services from outside India do so at their own risk and responsibility.

We reserve the right to terminate your membership and refuse access if you are discovered to be under 18 without proper consent, have provided false information, or violate any terms of this agreement.

Fee Modifications: The Mind & Company reserves the right to revise charges for services at any time without prior intimation. Any such changes shall take effect immediately and be binding.

The Website contains content owned or licensed by The Mindandko Private Limited ("Company Content"). We own and retain all rights in Company Content. You may not:

• Remove, alter, or conceal copyright, trademark, or proprietary notices
• Reproduce, modify, adapt, or prepare derivative works
• Perform, display, publish, distribute, transmit, or broadcast Company Content
• Sell, license, or otherwise exploit Company Content

The Mind & Company name and logo are our trademarks. Custom graphics, button icons, and scripts are our service marks. Use of our trademarks requires prior written permission.

You retain ownership of content you create and submit ("User Content"), but you are solely responsible for it. You may not post content that:

• Harmful Content: Creates a risk of harm, injury, emotional distress, or death to people or property, or seeks to harm or exploit children.
• Illegal or Inappropriate Content: Contributes to criminal activity or is unlawful, abusive, racially offensive, defamatory, threatening, harassing, or humiliating.
• Proprietary Violations: Infringes intellectual property rights, shares information without proper authorization, or violates confidential or fiduciary relationships.

By using our Platform, you consent to the collection, use, and disclosure of your Personal Information as detailed in our Privacy Policy. We are committed to protecting your privacy in accordance with applicable Indian laws.

Upon termination of your account, some information may remain on our servers for legal compliance purposes. To request data deletion, contact us at support@themindandcompany.com. We will process such requests within 30 working days, subject to legal requirements.

The Website and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, uninterrupted or error-free service, security or freedom from viruses, and accuracy or reliability of content.

We do not guarantee acceptance as a registered user, availability of specific Experts, specific therapeutic outcomes, or Expert professional conduct. While we conduct background checks and credential verification for all Experts, we do not endorse, recommend, warrant, or guarantee Expert qualifications, quality of services, or validity of Expert advice.

To the maximum extent permitted by Indian law, The Mind & Company shall not be liable for direct, indirect, incidental, consequential, special, or punitive damages; lost profits, revenue, savings, data, or replacement costs; service interruptions, errors, or unavailability; or actions or omissions of Experts or other third parties.

We act solely as an intermediary between you and the Experts. We do not assume responsibility for Expert actions, advice, or information provided; professional decisions made by Experts; therapeutic outcomes or treatment effectiveness; or Expert-client relationship dynamics.

You agree to indemnify, defend, and hold harmless The Mind & Company, its directors, officers, employees, affiliates, agents, contractors, and licensors from:

• Any breach of these Terms by you
• Your User Content and its consequences
• Claims arising from your use of our Services
• Attorney fees, court costs, and legal expenses
• Any breach of confidentiality by you

You shall provide us with reasonable assistance in defending any claims, including access to information, documents, and records as we deem necessary. You may not settle any third-party claim without our prior written consent.

Our Website may contain links to third-party websites ("Linked Sites") that are not under our control. We are not responsible for the content of any Linked Site, modifications to Linked Sites, any form of transmission from Linked Sites, and we do not endorse Linked Sites or their operators.

When accessing Linked Sites, you are governed by their respective terms of use and privacy policies. We may incorporate products or services from third-party providers on our Platform. By using such products, you agree to the terms and conditions of the corresponding third-party provider. Your forum communications and comments must not violate third-party rights, contain libelous or abusive material, include computer viruses, or use false email addresses or mislead others about your identity. You are solely responsible for your forum contributions and their accuracy.

In the event of any dispute, controversy, or claim arising from this Agreement, the parties will first attempt amicable resolution through designated officers meeting to negotiate and resolve issues.

This Agreement is governed by the laws of India. Subject to the arbitration clause above, the courts of Chennai shall have exclusive jurisdiction for any remaining disputes.
